MG+M The Law Firm Partners Brian D. Gross and Max Swetman will speak at the Plastics Industry Association's 2023 Plastics Fluoropolymers Conference.
Brian and Max will speak on a panel titled "What Moves Do You Make in a Universe of Uncertainty?" and will discuss the current uncertainty with respect to the way EPA will regulate various PFAS chemicals. Products and materials that contain PFAS are beginning to come under state, federal and international regulation with much more expected in the coming months. They will also discuss best practices for dealing with this uncertainty and strategies for recovery of costs associated with PFAS investigation and remediation. Topics they will address include:
- uncertainty concerning the maximum contaminant levels that EPA will propose
- uncertainty concerning which PFAS chemicals may be deemed hazardous substances under CERCLA
- what happens when those regulations are challenged through litigation
