Manning Gross + Massenburg LLP (“MG+M”) partner Brent Karren obtained a directed verdict on behalf of MG+M’s client American Biltrite Inc. in a living mesothelioma asbestos trial in Los Angeles County.
Plaintiffs Robert Friedman and Carole Friedman alleged that Mr. Friedman developed mesothelioma as a result of bystander exposure to the installation of vinyl asbestos tile at his home in 1966. American Biltrite was the only remaining defendant at trial. The case tried for seven days before a 12-person jury in Van Nuys, California. Judge Frank Johnson presided.
The plaintiffs were represented by Peter Beirne and Michael Reid of Weitz & Luxenberg and called industrial hygienist Steven Paskal and Dr. James Dahlgren, a specialist in internal medicine, as expert witnesses.
Following the conclusion of the plaintiff’s case, the court determined that the plaintiffs failed to adduce sufficient evidence to support causation of the plaintiff’s mesothelioma as a matter of law.
The case was tried by Brent Karren of MG+M’s San Francisco and Los Angeles offices and David Fisher of Kurowski Shultz LLC’s Illinois and New York offices.
