MG+M Secures Rare Summary Judgment Victory in Louisiana Asbestos Case

Overview

Although Louisiana courts rarely award summary judgment to asbestos defendants in mesothelioma cases, MG+M recently convinced Ad Hoc Judge Max Tobias of the 19th Judicial District Court for the Parish of East Baton Rouge, Louisiana to grant the motion of a large commercial truck manufacturer in a case involving alleged exposure to asbestos from replacement brakes.

During the Oct. 14 hearing, the Louisiana court denied multiple defense summary judgment motions that were based on arguments that manufacturers should not be held liable for exposures related to replacement parts that the manufacturer did not make, sell or provide. In fact, the court denied every defense motion on this same issue except the motion briefed and argued by MG+M.
