MG+M Secures Defense Verdict for Global Facilities Management Company

Overview

On September 24, 2025, MG+M The Law Firm Partners John Hugo and Daniel McCarthy secured a defense verdict in Barnstable Superior Court for a global leader in facilities management, including for the health care industry. 

MG+M’s client was contracted by a not-for-profit regional medical center in Massachusetts to service their medical equipment. The plaintiff, a radiology technician who had worked in the hospital’s pain clinic for more than 10 years suffered an injury to her rotator cuff and claimed that it was caused by the failure of MG+M’s client to properly inspect and service the steering and braking systems for a C-arm fluoroscopy and X-ray machine as required under its agreement with the medical center. The plaintiff sought to recover her medical bills of $180,000, $1.2 million in lost wages, and her pain and suffering. 

The MG+M team established that our client properly and timely responded to all service calls regarding the C-arm’s steering and braking system, and, if needed, ensured that any defects were promptly fixed. MG+M also established that the plaintiff’s rotator cuff injury was a chronic degenerative condition caused by years of maneuvering the machine, rather than the result of MG+M’s client’s failure to properly service the C-arm. 

Following a five-day trial and less than 90 minutes of deliberations, the jury returned a verdict in favor of MG+M’s client, finding that the company did not engage in any negligent conduct.
