Patent Indefiniteness After Dow: The Problem of Multiple Measurement Techniques

Overview

Commercial Litigation Partners Lawrence K. DeMeo and Howard P. Goldberg, and Associate Ethan W. Marks, wrote an in-depth article describing the recent Federal Circuit decision in Dow Chemical Co. v. Nova Chemicals Corp. (Canada) and its implications for patent owners in all industries. The decision both confirmed a new standard for indefiniteness, and demonstrated the new standard’s effect on patents that do not indicate which measurement technique should define the scope of the invention claimed.
