Professional Liability Risks and Insurance Considerations for Design Professionals Involved in Data Center Projects

MG+M The Law Firm is pleased to present part two of our Design Professionals Special Series: “Professional Liability Risks and Insurance Considerations for Design Professionals Involved in Data Center Projects.” Building on our May 6 session which focused on programmatic risks, contractual issues, and recommendations for design professionals involved in data center projects, this program will focus on key risk management considerations, potential professional liability exposures, and insurance-related considerations impacting these rapidly evolving projects.

The program will feature:

  • David Hatem, Partner, MG+M The Law Firm

David Hatem will discuss risk management considerations and potential professional liability claim scenarios associated with data center projects, including the roles of design professionals, standard of care, scope of services, design coordination, design revisions, design freeze considerations, future proofing, and the unique characteristics of large-scale and fast-moving megaprojects. The discussion will also address common project challenges and dispute scenarios involving delays, disruptions, suspensions, cost overruns, market shifts, equipment issues, labor shortages, supply chain disruptions, and other issues that may arise during the design and construction process.

Colin O’Neil will address professional liability and other insurance requirements applicable to data center projects, including common areas of risk exposure, sources of professional liability claims involving design professionals, available insurance structures and coverage options, the importance of professional liability insurance on these projects, project-specific professional liability insurance considerations, and key underwriting factors impacting the evolving data center market.

The session will conclude with practical recommendations to help design professionals manage risk, strengthen project execution strategies, and avoid disputes on these high-stakes projects.
