On June 25, 2026, MG+M The Law Firm's New York trial team secured a defense verdict from a Manhattan jury for its clients, an owner and construction manager, in a New York Labor Law construction case.
The plaintiff, a 33-year-old laborer, was working on the excavation and underpinning of a foundation wall. He claimed he suffered career-ending injuries when a 300-pound piece of concrete footing became dislodged, striking him.
After a three-week bifurcated liability trial and five hours of deliberations, the jury returned a unanimous verdict in favor of MG+M’s clients. The jury found that MG+M’s clients did not play a role in creating the alleged unsafe condition, nor did any of its activities cause the plaintiff's injuries. The jury found defendants, the professional design engineer for the support of excavation plan, 70% responsible and the plaintiff's employer 30% responsible.
The trial success was due to the outstanding efforts of the entire trial team, which included Partners Christian H. Gannon, Joel Merchant, and Ryan Sweeney; Associates Wade Bredin and Agustin Bujanda; Manager of AV Trial Technology Chris Baughman; Paralegals Diana Pham, Jillian Mulrooney, and Aaron O'Rourke; Medical Legal Consultant Sophia Larig; Legal Administrative Assistant Jackie Perez; and Law Clerk Mary Spillane.
