Overview

Jason Cincilla, who serves as partner-in-charge of MG+M’s Delaware office, is a litigation strategist and manager, and trial lawyer. In more than two decades of practice, Jason has helped companies resolve hundreds of high-stakes cases across a broad range of areas, including corporate, commercial, business, bankruptcy, employment, and product liability litigations. He has a wealth of experience in all Delaware state and federal courts and has represented clients successfully in state and federal courts throughout the country.

Put simply, Jason solves complex problems. He is uniquely adept at seeing and shaping the bigger picture throughout all phases of litigation. He excels at absorbing and shaping the whole of complex disputes, identifying the optimal outcome for his clients, and then moving all parties to that optimal outcome. Sometimes that requires aggressive litigation and trials; oftentimes it requires practical business solutions.  

Jason credits his military service for his success as an attorney. As a Ranger, Pathfinder, and Jumpmaster, he gained valuable experience in complex problem solving in life-or-death situations and tireless work ethic. When applied to the practice of law, those skills allow Jason to take on any legal challenge and the most capable opposing counsel.

A prior co-counsel of Jason’s in a complex commercial dispute complimented him as a "master of litigation jiu jitsu." Another observed that he has a "knack for commanding and shaping the battlefield" in difficult cases. Jason brings his big-picture focus, problem-solving acumen, and unwavering work ethic to every matter he handles. He stands ready to assist clients facing their most complex challenges.

Experience

  • Won a rare trial award of more than $20 million in punitive damages against an insurance company in a Delaware case, alleging that the company’s refusal to cover legal fees for the insured’s litigation was bad faith.

  • Won a defense verdict for a joint compound manufacturer in a Delaware mesothelioma case with no alternative exposures to asbestos products by convincing the court to exclude plaintiffs’ general negligence and design defect claims, leaving only a failure to warn claim (against a defendant that had provided adequate warnings).

  • Prevailed on a summary judgment motion by convincing a Delaware court to apply the Pennsylvania statute of repose to the claims at issue, despite the fact that multiple Pennsylvania trial courts had refused to do so.

  • Devised and executed a 50-state strategy to protect a client’s privileged document that had been wrongfully obtained and widely disseminated by plaintiff attorneys.

  • Led a national discovery team in responding, over a two-year period, to 465 sets of written discovery requests including over 200 sets of document requests. The team produced documents in response to only 10 of those sets of requests; faced only six motions to compel documents and/or information; defeated two of those motions; and convinced plaintiffs to withdraw the other four.
